TERMS OF SERVICE & SALE

These Terms of Service and Sale ("Terms") constitute a legally binding agreement between you ("Collector," "User," or "Customer") and cuSTARt LLC d/b/a TYPE SHIT ("Company," "we," "us," or "our"), a limited liability company organized under the laws of the State of Louisiana, with principal communications directed through wthecustart@gmail.com.

By accessing, browsing, submitting transmissions through, or acquiring limited archival specimens from this website (the "Platform"), you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with our Privacy Policy and 14-Day Exchange Policy. If you do not agree, you must immediately terminate use of the Platform.

The Platform and its catalog are hosted in the United States and operated exclusively for domestic commercial transactions within the fifty (50) United States and the District of Columbia. We do not solicit orders, market goods, or fulfill shipments to addresses located outside the United States.

You represent and warrant that you are at least eighteen (18) years of age (or the legal age of majority in your jurisdiction of residence) and possess the legal capacity to execute enforceable contracts.

[TYPE SHIT.] produces limited-run apparel and archival specimens released in strictly capped quantities ("Drops" or "Allocations"). Receipt of an electronic order confirmation or manifest ID does not constitute our legal acceptance of an order, nor confirmation of an agreement to sell.

We reserve the absolute right at any time after receipt of your order, without prior notice or liability to:

• Limit available allocation quantities per individual, household, payment card, IP address, or shipping destination;
• Cancel or refuse any transaction suspected of utilizing automated scripts, bots, scraper software, or bulk reseller syndicates;
• Correct typographical inaccuracies, description omissions, or erroneous pricing, and cancel affected unfulfilled orders with a full refund of any charged amount.

All prices are quoted in United States Dollars (USD). Applicable state and local sales taxes are calculated and added at checkout based on the designated shipping destination in accordance with applicable state tax laws. In accordance with applicable merchant surcharge rules, an electronic payment surcharge of up to 3.0% is applied at checkout to credit card and eligible digital wallet transactions to offset payment processing network costs.

Payment transactions are authorized and securely tokenized through the Square Web Payments SDK (Square / Block, Inc.), supporting major payment cards, Apple Pay, Google Pay, Cash App Pay, and Afterpay. cuSTARt LLC does not store, capture, or retain unencrypted payment card account numbers (PAN) or security codes (CVV) on our servers.

All orders are executed under shipment contracts. Pursuant to Uniform Commercial Code (UCC) § 2-509, title and risk of loss for all purchased specimens pass to you upon our physical delivery of the parcel to the designated third-party commercial courier (e.g., USPS, UPS, FedEx).

cuSTARt LLC is not liable for carrier transit delays, weather disruptions, porch piracy, or parcels delivered to inaccurate shipping destinations provided by the customer at checkout.

Due to the strictly limited, collectible nature of our archival drops, ALL TRANSACTIONS ARE FINAL FOR CASH OR PAYMENT CARD REFUNDS.

We grant a limited fourteen (14) calendar day exchange window starting from the carrier timestamp of delivery. Exchanges are subject to inventory availability and strict inspection: the specimen must be unworn, unwashed, unaltered, and enclosed within its original archival packaging with all serialized cards/golden tickets intact. All proprietary marks, trade names, wordmarks—including the trade name TYPE SHIT, stylized brand marks [TYPE SHIT.], [TS.], [cuSTART], and associated graphic logos—along with lookbook imagery, editorial copy, typographic arrangements, code, and digital assets are the exclusive intellectual property of cuSTARt LLC.

DMCA Copyright Agent: Pursuant to 17 U.S.C. § 512, if you believe content hosted on our Platform infringes your valid copyright, dispatch a written statutory notice to our Designated Agent:

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE PLATFORM, CATALOG, AND ALL SPECIMENS ARE PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL CUSTART LLC, ITS MANAGERS, OFFICERS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR ACCESS OR INABILITY TO ACCESS THE PLATFORM OR PURCHASED SPECIMENS. IN ALL CIRCUMSTANCES, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE EXACT DOLLAR AMOUNT PAID BY YOU FOR THE SPECIFIC SPECIMEN GIVING RISE TO THE CLAIM.

PLEASE READ THIS SECTION CAREFULLY. IT MATERIALLY AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, transactions, or communications shall be settled exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Governing Law & Venue: These Terms shall be governed by and construed in accordance with the substantive laws of the State of Louisiana, without giving effect to conflict of laws principles. The seat of arbitration shall be Orleans Parish, New Orleans, Louisiana.

CLASS ACTION WAIVER: YOU AND CUSTART LLC AGREE THAT ALL CLAIMS SHALL BE BROUGHT SOLELY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.
